How does West Virginia define what an electric bike is?
E-bikes are regulated like bicycles. The same rules of the road apply to both e-bikes and human-powered bicycles.
West Virginia designates two classes of e-bikes:
Class 3: Bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the e-bike reaches 28 mph.
Class 1: Bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the e-bike reaches 20 mph.
Class 1 e-bikes are allowed on bike paths, multi-use trails and single-use trails.
Do you need a license, insurance or registration in West Virginia?
E-bikes are not subject to the registration, licensing or insurance requirements that apply to motor vehicles.
What are the restrictions on Motor power or throttle in West Virginia?
Unfortunately, at this time, West Virginia does not recognize Class 2 e-bikes as bicycles.
Are there any age restrictions to riding an electric bike in West Virginia?
You must be 16 years or older to operate a Class 3 e-bike
What are the laws around helmets in West Virginia?
All operators and passengers under 15 years old must wear a helmet. Passengers on Class 3 e-bikes under the age of 15 must be on an e-bike driven by someone 18 years.
What are the rules for riding on the road in West Virginia?
E-bikes are not allowed on sidewalks. Consult your local authority or agency for information regarding whether e-bikes are permitted on bicycle paths in your area.
What are the rules for riding on the trails in West Virginia?
The West Virginia State Parks and Forest does not currently have a regulation regarding electric bikes.
