How does Virginia define what an electric bike is?

Virginia designates three classes of e-bikes:

Class 1: Bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the e-bike reaches 20 mph.

Class 2: Bicycle equipped with a throttle-actuated motor, and that ceases to provide assistance when the e-bike reaches 20 mph.

Class 3: Bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the e-bike reaches 28 mph.

Do you need a license, insurance or registration in Virginia?

The state of Virginia does not have licensing and registration requirements for electric bikes.

What are the restrictions on Motor power or throttle in Virginia?

Electric power-assisted bicycles are equipped with an electric motor with an input of no more than 1,000w.

Are there any age restrictions to riding an electric bike in Virginia?

You must be 14 years or older to operate a Class 3 e-bike. All operators and passengers of Class 3 e-bikes must wear a helmet.

What are the laws around helmets in Virginia?

Helmets are required for bike riders under 18 years old.

What are the rules for riding on the road in Virginia?

Electric bikes are allowed on all roadways with a posted speed limit of less than 25mph and on bike paths when yielding to pedestrian traffic.

Additional Notes:

  • All class 3 electric power-assisted bicycles shall be equipped with a speedometer that displays the speed the bicycle is traveling in mph.
  • No person shall tamper with or modify an electric power-assisted bicycle to change the motor-powered speed capability or engagement of an electric power-assisted bicycle.
  • An electric bike must have a motor that disengages or ceases to function when the rider stops pedaling or when the brakes are applied.
