How does New Mexico define what an electric bike is?

Motorized Bicycles are not considered to be mopeds or motorcycles.

By current MVD practice, motorized bicycles are considered to be bicycles (not mopeds or motorcycles) and are not subject to the titling and registration requirements of the Motor Vehicle Code.

Do you need a license, insurance or registration in New Mexico?

eBikes are not subject to the licensing and insurance requirements that apply to motor vehicles.

What are the restrictions on Motor power or throttle in New Mexico?

The state of New Mexico doesn't provide restrictions on motor power or throttle for eBikes. 

Are there any age restrictions to riding an electric bike in New Mexico?

The minimum user age is 15 years of age. 

What are the laws around helmets in New Mexico?

Helmets are required for all riders under 14 years of age when riding on roadways.

What are the rules for riding on the road in New Mexico?

Electric bicycles may be ridden on roadways, in bike lanes and on bike paths.

Additional Notes: 

Every bicycle (including electric bikes) when in use at nighttime shall be equipped with:

  • A lamp on the front which shall emit a white light visible from a distance of at least five hundred feet to the front and with a red reflector on the rear of a type approved by the division which shall be visible from all distances from fifty feet to three hundred feet to the rear when directly in front of lawful upper beams of head lamps on a motor vehicle.
  • A lamp emitting a red light visible from a distance of five hundred feet to the rear may be used in addition to the red reflector.

No one should ride a bike unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least 100 ft.

Every bicycle should be equipped with a brake which will allow the rider to make the brake wheels skid on dry, level, clean pavement.
